Ex-Marvell Technology Accountant Ng Released on $50000 Bond - Bloomberg

Former Marvell Technology Group Ltd. (MRVL) accountant Stanley Ng, charged in a nationwide crackdown on insider trading, made an initial court appearance in New York and was released on a $50,000 bond.

Ng, 42, didn?t enter a plea today at his first federal court appearance in Manhattan. U.S. Magistrate Judge James Francis agreed to release Ng on a bond secured by one financially responsible person and his California home and ordered him to surrender his passport. Both Ng and his lawyer, Silvia Serpe, declined to comment after court.

He was arrested Aug. 10 for allegedly leaking material non- public information to Winifred Jiau, a former consultant with expert-networking firm Primary Global Research LLC. He?s charged with one count of conspiracy to commit securities and wire fraud and faces as long as five years in prison if convicted.

Jiau, 43, was convicted in June of one count each of conspiracy and securities fraud after being caught in Manhattan U.S. Attorney Preet Bharara?s probe of insider trading involving so-called expert networking firms and hedge-fund managers.

Prosecutors said Jiau passed earnings and other information about Nvidia Corp. (NVDA) and Marvell to fund managers Noah Freeman, a former SAC Capital Advisors LP portfolio manager, and Samir Barai, founder of New York-based Barai Capital Management LP.

At Jiau?s trial, a witness testified that Jiau befriended Sonny Nguyen, a former Nvidia Corp. financial analyst, and Ng to obtain information she sold to Barai and Freeman. Ng tipped her about Marvell?s earnings in May 2008, prosecutors said.

The portfolio managers paid Primary Global $10,000 a month for exclusive access to Jiau, Freeman testified. She earned at least $208,000 from the scheme, prosecutors said.

Barai and Freedman have pleaded guilty and are cooperating with prosecutors.

The case is U.S. v. Ng, 11-02096, U.S. District Court, Southern District of New York (Manhattan).

Thirty-five-year-old Lawrence Godwin III of Camden was sentenced Wednesday after pleading guilty to breach of trust and forgery in December.

Circuit Judge Casey Manning sentenced Godwin to 90 days in jail and five years of probation. Godwin also must pass random drug tests to avoid a full 10-year sentence.

The money was taken in 2005 and 2006 and was discovered during an audit.

Godwin has repaid $59,000. The university's insurance company has paid the rest.

A psychiatrist testified for Godwin that he had become addicted to heroin and started stealing money to buy the drug.

Blazing Starry Trail: Accountant Finds Sixth Comet in Nine Months - Daijiworld.com

Thane (Maharashtra), Aug 27 (IANS): He spends most of his day at office and commuting to and from Mumbai in crowded suburban trains but accountant Shishir Deshmukh still finds time to look at the stars and pursue his passion for astronomy. And he has just discovered his sixth comet in just nine months, the first by an Indian.

His latest discovery was a Kreutz Group comet Thursday evening.

"I feel very thrilled by my discoveries, the first by an Indian. It gives great pleasure. Although I am an amateur astronomer, I have made a small contribution to the world of astronomy," an excited Deshmukh, who works as an assistant accounts manager with a leading realty group, told IANS.

The Kreutz Group of comets is named after a German astronomer, Heinrich Kreutz, who discovered that these types of comets - which travel around the sun and consist of a solid frozen nucleus part and a long luminous tail - have their orbits very close to the sun.

"These comets are generally very fragile, barely a few metres long and keep disintegrating throughout their orbit," explained Deshmukh, a commerce graduate from the University of Mumbai with an M.Phil in information science.

These comets are much smaller than the better known large comets like Halley's Comet.

"But they (the small ones) are very useful to the study of the dynamics of orbits of comets, their disintegration process and perturbations from giant planets," he added.

"Actually, what we are seeing now in the form of Kreutz Comets is the debris or left-overs of very large comets which come in the vicinity of our solar system once in a few centuries.

"From the orbits of some of the Kreutz Comets, it is estimated that one such huge comet was seen in 1106, then in 1882 and last in 1965," Deshmukh, 37, explained.

Besides, some short period comets are also observed using Solar & Heliospheric Observatory (SOHO) data, which help scientists understand their orbital dynamics and rate of erosion each time they visit our solar vicinity.

On the basis of their observations, astronomers can estimate their expected time of return - and the possible risks to mankind, he said.

Detailing his achievement, Deshmukh said it involves a furiously competitive study of images of the sun sent by SOHO, which is a space observatory between the sun and earth, some 1.5 million km away from our planet.

"It beams one image every 12 minutes which is uploaded on its official website 24x7 and picked up by astronomers worldwide. I also studied them, measured the positions of any suspicious objects, picked out my claims and submitted them for confirmation, including the one yesterday (Thursday)," he said.

"My latest discovery - yesterday evening - has also been acknowledged as genuine and the official confirmation is expected soon," Deshmukh said.

The plaudits have been many.

Deshmukh was felicitated for his achievement by former president A.P.J. Abdul Kalam in Dombivali last March.

In January this year, Deshmukh, co-author of a book, "Astronomy of Eclipses", was commended and felicitated by eminent nuclear scientist Anil Kakodkar for becoming the first Indian amateur astronomer to get international recognition as a discoverer of SOHO comet.

He will speak on "Comet Hunting With SOHO" at a major felicitation organised by the Bombay Amateur Astronomers Association Saturday.

In the past 15 years or so, a total of 2,122 Kreutz Group of comets have been discovered by professional and amateur astronomers worldwide.

German astronomer Rainer Kracht holds a tally of 225 discoveries.

Other astronomers have made smaller individual discoveries, including Deshmukh, of course.

Prior to Deshmukh, late Indian astronomer M.K.V. Bappu of Andhra Pradesh along with two international scientists, discovered a conventional comet which was later named after them as 'Bappu-Bok-Newkirk Comet' in 1949.

Lifting of pre-audit risky for officials

CEBU, Philippines -Cebu City accountant Marietta Gumia said that the lifting of pre-audit may speed up the process of government transactions but it also presents disadvantages especially in the implementation of infrastructure projects.

Gumia said unlike the Commission on Audit, the city accounting office has no technical personnel who can evaluate the technical aspects of the projects or conduct inspection if applicable because her office only based their examination on documents submitted to their office.

Gumia said the pre-audit also helps the government to discover early the discrepancies of their requirements so they have time to correct it before a project is implemented.

?Ang advantage pud unta sa pre-audit is dili na sila mu-post audit if post audit is no longer necessary or at least gamay na lang ang i-comply during post audit,? Gumia said.

Now that the pre-audit has been lifted, Gumia said the government will not be given observations but will directly issue notice of suspension or disallowance in which the signatories of the vouchers will beheld liable.

?That?s the risk for the accountant, the examiners and the signatories,? Gumia said.

COA issued a Circular No. 2011-002 in July 22 lifting the pre-audit of government transactions. COA also ordered the return of all pending vouchers to the agency concerned.

Some city officials were delighted to the recent rule of COA because it would speed up the implementation of the projects and would fast track the payment to contractors and suppliers.

But as of yesterday, COA in Cebu City only returned seven vouchers so far.

These seven vouchers include a voucher under Dr. Myrna Go?s name, salary of the beneficiaries of the Special Program for the Employment of Students, a voucher worth P3 million for the Cebu Surgical and Medical Enterprises, for Geronimo Malabago, for Berovan Marketing and the voucher for the final payment of E.M. Arante Construction worth P6 million.

Gumia said she has no idea how many vouchers are pending at COA because it is the City Administrator?s Office that submits the vouchers to COA for pre-audit.

Before COA Circular No. 2011-002, all government transactions worth P2 million and above are subjected to pre-audit. ? (FREEMAN)

Accountant convicted on theft charges - Delaware Wave

SNOW HILL -- Accountant William W. Scott was found guilty on three counts of theft and was convicted of stealing more than $800,000 from three Ocean City condominium associations.

Judge Richard Bloxom said the state's evidence -- which included a recorded confession Scott voluntarily gave to the Worcester County Bureau of Investigation -- and the testimony of multiple witnesses proved to him there was no reasonable doubt Scott had taken money that did not belong to him and he was not authorized to take.

Two of Scott's crimes carry a sentence of 20 years, with 10 years suspended and five subsequent years of probation, while the third carries a sentence of 15 years with five years suspended and five years of probation. The sentences will be served concurrently, meaning Scott is likely to be incarcerated for 10 years total. Restitution will be included in the sentence, at an amount to be determined at a later time.

During sentencing, Scott, 37, of Bishopville tearfully apologized to his victims and family and told the court he had secured two job offers within the state and, if he avoided prison time, he could begin working toward paying back the association members from whom he'd stolen the money.

"I want to make things right," he said.

Scott told the court he thought initially that his exit strategy from his financial problems would be to take his own life, but he ultimately decided against it, saying he couldn't abandon his 6-year-old son.

Bloxom told Scott he felt the court's sentence had to reflect society's "condemnation" of Scott and its "repugnance" at the crimes he committed.

Bloxom said the court had no reason to doubt the sincerity of his aforementioned apologies, but his thefts were "staggering in their amount," and the manner in which they were executed were "surprising and shocking" in their deviousness.

Scott was acquitted of one theft charge wherein he was accused of stealing money from an individual who had mailed him a check paying for a portion of her condo fees. Bloxom ruled that Scott had been stealing from her condo association, and not her, since Scott was authorized by the association to collect dues.

The amount of restitution Scott owes will be determined once it is decided what the associations are to do with money Scott occasionally transferred between the entities' accounts.

Ex-accountant of Bataan gov?t found dead; cops eye suicide - Global Nation

PILAR, Bataan, Philippines ? A former provincial accountant of Bataan was found dead with a bullet wound in the head inside his house in Barangay Rizal here on Monday, police said.

Initial reports said the wife of Numeriano Medina, 57, found him holding a .45 cal. pistol near the gate of their house before he was found dead.

Senior Supt. Arnold Gunnacao, Bataan police director, said it appeared that Medina, the administrator of the Bataan Common Terminal, shot himself in the mouth. The bullet pierced through Medina?s nape, killing him instantly.

Neighbors said they heard a gunshot shortly before 5 a.m. but they ignored it, thinking that somebody might have fired at the rats that abound in the village.

Medina and lawyer Renato Bagay, former legal adviser of former Bataan Gov. Leonardo Roman, had been recommended for dismissal from government service in connection with a graft case filed by Gov. Enrique Garcia Jr. with the Ombudsman.

Garcia filed the graft case in 2006 against Roman, Bagay, Medina, former Bataan administrator Romeo Mendiola and former Board Member Gregorio Uy before the Ombudsman in connection with a P290-million loan to fund the construction of Peninsula Heights, a government housing project in Samal town.

Ex-Marvell Technology Accountant Ng Charged in Insider Probe

August 11, 2011, 8:00 PM EDT

By Bob Van Voris

(Updates with arrest in third paragraph.)

Aug. 11 (Bloomberg) -- U.S. prosecutors charged former Marvell Technology Group Ltd. accountant Stanley Ng with conspiracy as part of a nationwide probe of insider trading involving so-called expert networking firms.

Ng, 42, provided material non-public information to Winifred Jiau, a former consultant with expert-networking firm Primary Global Research LLC, according to a criminal complaint filed Aug. 5 and made public yesterday in federal court in New York.

Ng was arrested at his home and appeared yesterday before U.S. Magistrate Judge Bernard Zimmerman in San Jose, California, according to a statement by U.S. Attorney Preet Bharara in New York. Ng was released on a $50,000 bond secured by his home in Cupertino, California, and is scheduled to appear Aug. 26 in court in Manhattan. He faces as long as five years in prison if convicted.

Jiau, 43, was convicted in June of one count each of conspiracy and securities fraud for passing earnings and other information about Nvidia Corp. and Marvell to hedge fund managers Noah Freeman, a former SAC Capital Advisors LP portfolio manager, and Samir Barai, founder of New York-based Barai Capital Management LP.

Barai and Freedman have pleaded guilty and are cooperating with prosecutors.

Investment Club

Prosecutors claimed that Ng and Sonny Nguyen, 39, then an employee in Nvidia Corp.?s finance department, were recruited into an ?investment club? with Jiau, where they agreed to give her inside information about their companies. Nguyen has pleaded guilty.

Jiau gave the two men gifts and bought them meals at the Cheesecake Factory and other restaurants, according to the complaint. In May 2008, Barai sent Jiau an e-mail asking for the ?M cookbook recipe,? referring to Marvell?s non-public earnings information, according to the government. Based on information from Ng, Jiau told Barai that the company?s earnings per share exceeded analyst expectations by as much as six cents, according to the complaint.

Three months later, Barai asked Jiau again for the ?M recipe,? or information on Marvell?s new quarterly earnings, according to the complaint. Marvell, based in Santa Clara, California, makes chips for personal computers and mobile phones.

?My Cook?

Jiau explained to Barai her reluctance to call Ng too often.

?Sorry. My cook feels like he is watched,? she told Barai in an instant message, the government said.

Expert networking firms such as Primary Global, based in Mountain View, California, link investors with industry experts at public companies.

Jiau was the first of the so-called expert networkers to go to trial. The U.S. has charged at least 15 people, including consultants and fund managers, with insider trading in the investigation of expert networking firms. At least 12 people have pleaded guilty in the investigation. James Fleishman, a former Primary Global sales manager, is scheduled to be tried later this month.

Galleon Group LLC co-founder Raj Rajaratnam was convicted May 11 of directing the largest hedge fund insider-trading ring. Prosecutors are seeking a prison sentence of as long as 24 years and five months for Rajaratnam. Ex-Galleon trader Zvi Goffer was convicted with two others June 13 on related charges and faces as long as 20 years on the most serious counts.

Jiau?s Trial

Jurors at Jiau?s trial saw evidence of Barai?s fund buying hundreds of thousands of shares of Marvell stock in May 2008 after obtaining information Jiau allegedly got Ng, who worked as an accountant for Marvell and allegedly tipped her about the company?s earnings in May 2008.

Prosecutors showed the jury evidence that Jiau had also worked at Nvidia briefly in 2007. She befriended both Nguyen and Ng to get her the information she then sold to Barai and Freeman.

Ng was hired by Marvell in 2002 to be the company?s SEC reporting manager, according to the complaint. He had access to the company?s financial records and regulatory filings before they became public, according to the government.

Ng was placed on administrative leave by Marvell in January after he refused to cooperate with an internal investigation, according to court records.

The case is U.S. v. Ng, 11-02096, U.S. District Court, Southern District of New York (Manhattan).

Accountant tied to scheme settles - The Business Journal

The Securities and Exchange Commission filed a settled civil action against an accountant and his consulting firm alleging participation in a multi-million dollar Ponzi scheme orchestrated and run by Joseph S. Forte, the Philadelphia Business Journal reports.

The action filed in U.S. District Court in Philadelphia charges John N. Irwin and his firm, Jacklin Associates, with participating in the scheme from at least February 1995 through December 2008.

Forte, a Philadelphia-area fund manager, was sentenced in late 2009 to 15 years in prison for running a Ponzi scheme that cost investors $35 million. Broomall, Pa.-based Forte pleaded guilty to wire, mail and bank fraud as well as money laundering.

The Commission?s complaint against Irwin and Jacklin alleges that they participated in Forte?s scheme by soliciting investors for Forte.

Irwin and Jacklin agreed to settle the Commission?s charges, without admitting or denying the allegations in the complaint.

Under the settlement, which is subject to the court?s approval, Irwin and Jacklin consented to a judgment permanently enjoining them from violating sections the Securities Act of 1933 involving fraudulent interstate transactions. The judgment also orders the defendants to pay disgorgement plus prejudgment interest, and permits the SEC to ask the court to impose undefined civil penalties.

Bishop: 'Listen to what they had to say'

CINCINNATI, July 11 (UPI) -- Cincinnati Archdiocese Auxiliary Bishop Joe Binzer -- a former accountant -- says he learned one of the best ways to solve problems is careful listening.

Binzer already had a career as an accountant when a friend asked him what he wanted to do with the rest of his life and then suggested he become a priest, The Cincinnati Enquirer reported.

Binzer said he considered his friend's remark, then prayed about it for a year before deciding to enter a seminary in 1988. He was ordained in 1994.

The church official who gave Binzer his job at the archdiocese said the ex-accountant's attention to detail helps him succeed.

"He's willing to face problems and deal with them," said retired Archbishop Daniel Pilarczyk. "I knew that whatever it was he was going to get the job done."

Binzer has had to deal with child sexual abuse claims that rocked the Catholic Church.

He said the first thing he does is say, "I'm sorry."

"When somebody came in and explained what happened, I'd apologize," Binzer said. "I just tried to listen to what they had to say, tried to learn what I could about the impact on their life and their families."

Town of Lake George hires accountant for regular audits - Post-Star

LAKE GEORGE -- The town has hired an outside auditor to conduct monthly reviews of its books.

The Town Board voted 3-1 with one abstention Monday to hire local certified public accountant Mary McKrell at a rate of $150 per hour. Councilwoman Fran Heinrich opposed the hiring because she said she had not been able to reach McKrell for an informal interview.

The hiring comes as the town tries to grapple with a recent audit by the state Office of the Comptroller that found significant issues with local payroll, procurement and purchasing procedures, and a lack of Town Board oversight.

McKrell has regularly worked with the town for more than a decade, and officials credited her with stepping in to help with other challenges, beginning when a town comptroller suddenly resigned in the mid-1990s.

"She has no conflicts of interests or anything. She worked with my wife for years," said Supervisor Frank McCoy.

Lake George Comptroller Kathy Gleason suggested McKrell's services only be accessed a few times a year. But Town Board members thought a regular review would better fit what the public has been seeking over the last two months.

"The public wants CPA involvement," said Councilman Vinnie Crocitto.

Crocitto suggested the Town Board interview McKrell prior to the hire, but he was overruled.

"I want to get this moving," McCoy said.

McKrell has already been assisting the town with some minor reviews of its books, which Heinrich said was inappropriate.

"The board never OK'd it," she said. "We need to be involved with what she is working on."

Councilwoman Caryl Clark abstained from the vote to hire McKrell.

Ettamogah spirit still strong despite pub troubles

Phillip Worsley, friend and muse to Ettamogah Pub creator Ken Maynard. Worsley says his late mate would be 'disgusted' by the controversy surrounding the Ettamogah empire.

PHILLIP ''Worso'' Worsley, mild-mannered accountant, first met cartoonist Ken Maynard of the now defunct Australasian Post magazine in 1972. Maynard was living in Sorrento at the time; the pair were introduced by a mutual friend at the Carlton Hotel in Albury.

''I shook his hand,'' says Worsley, ''and the moment I touched him I knew I had to stick with him.''

Worsley only has one eye. The other one lost a battle with a nail when he was 16. He's now 68. ''Call it a blind man's sense,'' he says. ''But when I met Ken I was immediately struck just by being in his presence.''

Advertisement: Story continues below

That first meeting was the start of an intense relationship between the pair until Maynard's death from liver cancer in 1998, aged 70, his legacy as an iconic Australian cartoonist in no doubt.

Yet Maynard's work has been sullied by the sorry saga of his most famous creation, the Ettamogah Pub, which he began drawing in the 1960s as a fictional watering hole for his knockabout Aussie characters. The cartoons became a mainstay of the popular magazine, often seen in barber shops or doctors' waiting rooms.

In the '80s a real Ettamogah Pub was built near Albury, based on Maynard's cartoons, as a tourist attraction and family restaurant. In May this year, it shut amid allegations owner and Melbourne businessman Leigh O'Brien was $9 million in debt.

There are now four Ettamogah Pubs in Australia. A former staff member of the pub is also claiming $30,000 in unpaid wages. One of Mr O'Brien's companies was placed in liquidation over $375,857 in unpaid fees. He has also this year pleaded guilty in court to stalking a former business associate.

Maynard, says ''Worso'' - who lives semi-retired on the banks of the Murray, not far from the boarded-up Ettamogah Pub - would be disgusted. He was a clever, dedicated man, he says, but naive with money and contracts, and often taken for a ride by those eager to cash in on his art. ''He was a true artist,'' says Worsley. ''Couldn't handle money, couldn't be controlled, couldn't be relied on.''

Says Worsley's wife Sandra: ''He had beautiful eyes.''

He was quiet, says Worsley. ''He would look you over.''

As an accountant, Worsley took an interest in Maynard's often wayward financial affairs over the years they were friends. He protected him as best he could from those running the Ettamogah enterprises.

Yet the real bond between them was based on that odd feeling Worsley had when they first met - the feeling that they were close in ways not immediately apparent, that they had a ''spiritual'' connection despite both being men more fond of earthly delights.

It started in 1977 when Maynard drew Worsley for the first time. The artist had become very interested in Worso's fishing stories and most particularly his endless pursuit of Murray Cod. He began ringing him weekly for yarns then drawing the results.

And so it was that the accountant became a hairy, singleted fishing yob in the pages of Australasian Post for 20 years, depicted with hat askew, surrounded by beer cans and fishing detritus.

To Maynard, Worso had become the Australian everyman, the voice of the people.

When Maynard was dying, Worsley often visited him in Brisbane. The last time he saw him he says his mate was looking all right but when they said goodbye, ''his eyes glowed yellow, you wouldn't believe it''.

Worsley flew home but woke suddenly at 5.50am, the exact time Maynard died, with a sensation even stranger than the one that struck him when they first met. ''An angel touched me on the shoulder,'' Worsley says, ''and said 'Ken's gone'.''

Emmett accountant appointed to Idaho State Tax Commission - Lewiston Morning Tribune

Idaho Gov. C.L. (Butch) Otter has appointed Emmett accountant Rich Jackson to a six-year term on the Idaho State Tax Commission.

Jackson, 67, has a long history of public service. He previously served as chairman of the Idaho Legislative Compensation Committee, which makes recommendations on pay and benefits for state lawmakers, as well as treasurer of the Idaho House of Representatives Republican Caucus and was a former chairman of the Gem County Republican Central Committee.

To ensure transparency and prevent the appearance of any conflict of interest, Jackson said he will step down from the withdraw from his accounting partnership and will recuse himself from any Tax Commission issues involving former clients, his partner or his employees.

The other appointees to the four-member commission include former Republican Senate President Pro Tem Bob Geddes and Democrats Tom Katsilometes and David Langhorst.

Jackson will fill the vacancy created when Otter appointed then-Commissioner Severina Haws to the Idaho Commission on Aging.

Martin Bates was made redundant from a US bank in 2008. Unable to face the prospect of finding another job as he approached 60 he took time out to consider his future.

He also dusted down all the unfinished novels that had begun to gather dust under his bed. He then promised to read them all one last time before shredding them.

Yet, one had passed the test of time. Martin told the Recorder: ?There was one that I read and it had a lot of power for me. I thought I can?t shred this. I?m going to re-write this.?

However despite his original conviction about the book, it was another 18 months before he had something that could be presented to publishers.

It was a literary editor who helped Martin produce the finished work, goading him to do better and raising the bar every time he reached a milestone.

Now Martin, who lives in Capel Road, Forest Gate, has published it, calling it The Little Girl of the Favela. It is set in the 1980s and its central character is a psychic girl from the slums of Rio who arrives in London with hopes of making her fortune.

It is an eclectic mix of humour and spiritual insights some of which must stem from his experiences of life, perhaps gained during a decade of travelling the globe. In India he spent time with the Maharishi Mahesh Yogi, famous for teaching The Beatles to meditate.

Although he made a good living as an accountant, writing has always been his passion. Martin said: ?I used to read a lot as a boy. I was very good at creative writing and got an A for ?O? Level English. I used to get a quite a few accolades. Beyond that I used to write casually but it was really in the 1980s that I wrote a lot. That was my most productive period of writing - I wrote lots of short stories and started quite a few novels.?

Martin will have a stall at the Forest Gate Festival in Osborne Road tomorrow where he will be signing copies of his book.

For each book sold, Martin will donate 1 to Richard House Children?s Hospice.

Pointers for Finding a Good Accountant - Associated Content

For those who know nothing about filing or organizing their taxes, hiring a tax accountant is a must. You do not just hire any accountant to do organize your finances for you however; you must find a good one so you'll be sure that your taxes are handled properly. Hiring just anyone off the street is risky-you'll be hiring an accountant to make things easier for you, to guide you and help you with your taxes and you shouldn't risk relying on someone you don't have the confidence in to do that job.

If you are one of those people who are looking for a tax accountant, consider these pointers first before hiring anyone.

Ask for recommendations. This is always a good start-off point in hiring a tax accountant. Ask people you know who have their finances in check if they can recommend someone who can do your taxes for you. Business associates or friends are good people to go to to ask for recommendations since they will give you an honest opinion on how their accountant performs as well as the good and bad points about the accountant that they hired. Be sure to ask several friends and colleagues as well, not just one or two.

Once you have asked for accountant recommendations, list down their names and contact information for easy reference. If you can remember the good and bad points given by those who have recommended them, it is good to note them as well in pros and cons.
